In 2003, Atlas revealed a massive accounting scandal, saying its books were "intentionally" fudged. The company restated two years' worth of earnings, fired its senior management team, and halted distributions. The units plunged, and have traded in the $4 to $6 range for the past two years.
Atlas unitholders holding about 20.6 per cent of the outstanding units have agreed to accept the higher bid from Avion and have signed irrevocable lockup agreements. About 13.8 per cent of Atlas's units are already owned by Avion and KingStreet Capital Partners.
