By referencing the same items in the second fiscal quarter (Q2) of 2001 and by using the volume from 2000, staff extended the prices for each item again for comparison. Depending upon the contract terms and other factors, some prices increased, some decreased, and some remained the same. The total cost for the same basket of goods for Q2 2001 was $1,047,742.00. Lawyers representing BCE, the buying group, shareholders and the bondholders disagreed on most aspects at the Tuesday hearing, but focused on one key issue -- What duty did the BCE board of directors have to bondholders, other than ensuring they kept receiving interest payments and the principal upon maturity of the debt? In opening arguments, BCE counsel Guy Du Pont argued that the directors had a duty only to do what is best for the company and its shareholders and their obligation to bondholders was to meet contractual obligations to pay interest and repay principal. If you look at all the stakeholders and their conflicting interests, it would put the board in an irreconcilable position," Du Pont said. "There is no duty to consider beyond the contractual rights of the bondholders.

The founders of Internet phone service [Skype] have filed another lawsuit that may put a wrench in eBay Inc.'s plan to sell Skype for US$2 billion to a private investor group, including the Canada Pension Plan Investment Board. In a lawsuit filed Friday, Joost N.V. and Joltid Ltd. sued former Joost CEO Mike Volpi, alleging he breached his legal duty to Joost by using confidential information to form a deal with eBay to buy the majority of Skype. Volpi is a former Skype board member and partner at Index Ventures, part of a group of private investors buying Skype. He stepped down as Joost CEO in July, but remained its chairman until just after eBay announced in early September that it would sell Skype. WCE Holdings Inc., the exchange's parent company, entered into a "definitive agreement" in June to be sold to ICE, a big player in energy and "soft" commodities as coffee, sugar and cocoa beans. He was intrigued about the prospect of buying into the Nationals because of their proposed Aboriginal ties.
