In a roundtable discussion, several procurement professionals discuss what the public procurer should do to make sure the procurement process is fair and equitable. Garth Whyte, national vice president of the Canadian Federation of Independent Business, said that like many aspects of public sector procurement, the devil is in the detail. Business can understand why governments may want to pre-qualify vendors. It is crucial that government procurement specialists have the expertise and resources to research and assess the capabilities of the full range of suppliers, including those that may not be traditional. John Holinsky, director general, Commercial Acquisitions and Supply Management, Public Works and Government Services Canada, said that in any contract-award process including those...

Kitchener was among the first to specify that certain products were to be used exclusively in their commercial properties. Traditionally, a contract would just involve the supply and delivery of a product. However, the city saw a real partnership opportunity with Gerrie Electric Wholesale Limited, one of the largest independent electrical distributors in Canada and Sylvania Lighting Services, the industry leader in lighting service and maintenance. "It seemed like a natural fit to me to bring our vendor of record, Gerrie Electric, and the manufacturer, Osram Sylvania, into one agreement," said Steve Rudak, buyer, purchasing, Financial Services Department for Kitchener. "Although it took a good deal of time to organize and get the buy in, at the end there is added value and the tendering...

[Anne Steinemann]'s study focused on six widely used products: dryer sheets, fabric softener, laundry detergent, a liquid spray air freshener, a plug-in air freshener, and a solid disc deodorizer used in commercial-airplane toilets. A contract laboratory sealed each product inside a container, then used two types of instruments to identify chemicals emitted into the air.
Collectively, the six products gave off nearly 100 volatile organic compounds (VOCs), including acetone -- the eye-stinging ingredient in nail-polish remover and paint thinner. (VOCs are compounds that vaporize easily, like paint and gasoline fumes. Many VOCs are known to be harmful.)
Among them are three chemicals the Environmental Protection Agency considers "hazardous air pollutants" with no safe exposure levels: ace...

The SCC also expressed concern that recognizing a negligence claim on these facts presented the problem of indeterminate liability. It noted that since one of the plaintiffs was a subsidiary to a supplier, the class of potential plaintiffs would "seep into the lower levels" of the design build team and each supplier would in turn have employees and sub-suppliers who might wish to advance a claim. The SCC further observed that the "construction contract context" is one where issues of "indeterminacy" can "readily be seen." It regarded recognition of a duty of care in the circumstances as leading to an "undesirable" number of tort actions.
The deference shown by the SCC to the suggested contract remedy is also unpersuasive. It ignores the fact that that the Contract "A" remedy, which the ...

It's the first contract for the migrant agricultural workers in Canada, which is significant, and it marks the recognition both from our legislature and labour board, that we want to be treating new immigrants and new Canadians equally," said Robert Ziegler, president of United Food and Commercial Workers local 832.
"Some people say a contract (for agricultural workers) won't work, the job is different, but this showed we can work with a farmer and come up with a collective agreement that works with their interests and the workers," Ziegler said.
