Last March, Friends of the Earth joined forces with several other groups, including the Manitoba Chambers of Commerce, to ask NAFTA's Commission for Environmental Cooperation (CEC) to step in and investigate the Devils Lake outlet. The groups contended the U.S. and Canada were violating environmental law by not having the outlet reviewed by the International Joint Commission.
The CEC said while both countries signed the 1909 Boundary Waters Treaty, the U.S. has never enacted legislation to enforce it in that country, and while Canada has such legislation, it is too vague for the CEC's requirements.

In a Computerworld article (July 2007) titled "Green IT: Marketing ploy or new tech," Bruce Hoard introduced the term "greenwashing." Referencing comments from a Greg Schulz interview (Schulz is the founder and senior analyst at Minnesota-based StorageIO Group), Hoard reports Schulz's assertion that recent'green' IT efforts have less to do with the environment and more to do with a vendor's bank roll. One example Schulz gave was a manufacturer's claim that their new,'green' storage technology can cut data center power and cooling costs by 50 percent. Schulz believes this is "simply a shift to another technology," touted as being a 'green' initiative.

The Commission for Environmental Cooperation is not performing its duty as an environmental watchdog. It has failed to act on complaints regarding a series of environmental deregulation being implemented in NAFTA member countries because of political constraints and loopholes.
