Apotex is taking a huge risk in launching its medicine because if a court later rules its product infringes on the Plavix patent, it will have to pay damages to Bristol-Myers and Sanofi-Aventis.
The recent focus on generic Plavix began in late July when Bristol-Myers and Sanofi-Aventis announced the Justice Department had launched a criminal probe into an out-of-court settlement the companies brokered with Apotex.
Bristol-Myers and Sanofi-Aventis were prepared to pay Apotex a reported minimum of $40 million to delay launch of its FDA-approved generic version of Plavix until June 2011, the year the primary patent protecting Plavix expires. FBI agents with a search warrant confiscated documents at Bristol-Myers' Manhattan headquarters, and Sanofi-Aventis was served with a grand jury subpo...

Last month, the U.S. Attorney's Office for the Central District of California notified New Century that it was conducting a criminal inquiry into trading in the company's stock and into accounting errors over loan repurchase losses.
Last month, the company said it lost track of how frequently borrowers missed payments on their mortgages. Because New Century's books didn't reflect how often borrowers defaulted and how likely borrowers were to default in the future, the value of the company's loan portfolio was overstated.
The company is now under pressure from several lenders to pay back what it owes them. One of its backers, UBS Real Estate Securities Inc., is demanding New Century's subsidiaries pay immediately some $1.5 billion in repurchase obligations for outstanding mortgage loans,...

The decision by U.S. District Judge Jeffrey White means reporters Lance Williams and Mark Fainaru-Wada must appear before a grand jury investigating the leak unless a higher court blocks the ruling. The pair have said they would not testify and would go to jail rather than reveal their source or sources.
The two reporters published a series of articles and a book based partly on transcripts of testimony by [Barry Bonds], Jason Giambi and others who testified in the grand jury investigation of the Bay Area Laboratory Co-Operative. Known as BALCO, the nutritional supplement company was exposed as a steroid ring.
