Amir Hussein Rahimi, spokesman for the parliament's Judicial and Legal Commission, says the commission will restore an article that says "a man can marry a second wife under 10 conditions." A husband would not have to get his first wife's permission if, for example, the first wife is infertile or fails to "co-operate" with her husband sexually. Conservative members of the parliament are promoting the change as a move that supports Islamic law. Some have said "polygamy is Islam's honour." But Iranian women are nearly unanimous in their opposition to the move. A survey in 2008 showed 96 per cent of Iranian women disapprove of allowing a man to take a rival wife. Women's right groups say the proposed new law is particularly intolerable given the existence of other measures that discriminat...

This paper sets the current debate about Canada's criminal law prohibiting polygamy in an historical, social and legal context, and argues that this law is constitutionally valid and sound social policy. Unlike the recognition of same-sex marriage, which promoted equality and saved government resources, the recognition of polygamy would promote inequality and impose costs on Canadian society. The social reality of polygamy is often exploitative of women and harmful to children, and its practice is contrary to fundamental Canadian values. If Canada's prohibition on polygamy is ruled unconstitutional, we would likely have to allow immigration by polygamous families. Western European countries, which allowed immigration by polygamous families in the past, experienced significant social and...

The "Middle Eastern Muslim family" has long been described as a patriarchal unit, and it has been noted that Muslim family laws have served to reinforce patriarchal gender relations and women's subordinate position within the family. The persistence of patriarchy is a matter of debate, and some feminist theorists argue that industrialized societies are also patriarchal. Walby (1990,1996) distinguishes between the "private patriarchy" of the pre-modern family and social order and the "public patriarchy" of the state and labor market in industrial societies. In his work on South Korea, lie (1996) has distinguished between agrarian patriarchy and patriarchal capitalism. In this article I use the term patriarchy in its strict rather than liberal sense-that is, in terms of [John Caldwell]'s ...

What most people think they know of sharia is that it is repressive toward women, and wedded to archaic and brutal physical punishment," [Rowan Williams] said. He quoted a Muslim scholar, Tariq Ramadan, as saying that in the West, "the idea of sharia calls up the darkest images of Islam." But Williams hopes there can be compromises and ways to accommodate a "constructive relationship" between Islamic law and the statutory laws of the United Kingdom without compromising traditional British freedoms. Williams pointed out that this was a problem not just for Muslims, but for Orthodox Jews who, on certain issues, may prefer to defer to rabbinical rules. He quoted the Jewish legal theorist, Ayelet Schachar, as wanting to move away from a single jurisdiction over "socially defining roles and...
