  • Human trafficking is a global human rights issue that has profound and tragic repercussions for millions of women and children every year. In North America, Canada is currently a destination for victims of trafficking, and a transit route into the United States. Traffickers have exploited the open border between the United States and Canada to perpetuate a modern form of slavery that forces oppressed women and children into forced labour and/or prostitution. Currently, Canada has no formal policy or program to provide protection, assistance, and services to victims. A multidimensional approach to combating human trafficking is necessary in Canada, with legislation that provides protection to victims escaping the web of trafficking.

  • This paper sets the current debate about Canada's criminal law prohibiting polygamy in an historical, social and legal context, and argues that this law is constitutionally valid and sound social policy. Unlike the recognition of same-sex marriage, which promoted equality and saved government resources, the recognition of polygamy would promote inequality and impose costs on Canadian society. The social reality of polygamy is often exploitative of women and harmful to children, and its practice is contrary to fundamental Canadian values. If Canada's prohibition on polygamy is ruled unconstitutional, we would likely have to allow immigration by polygamous families. Western European countries, which allowed immigration by polygamous families in the past, experienced significant social and...

  • In the spring of 2005, Canada, the United States, and Mexico negotiated a security and Prosperity Partnership (SPP), an agreement meant to bolster continental security while preserving a free flow of goods and people across national borders. After the SPP was announced, influential groups in all three countries argued that the new agreement should lead to the erection of a continental security perimeter. This paper argues that proponents of a continental perimeter overlook the mutual self-interest Canada and the United States see in focusing security cooperation on the border in a bilateral cooperative, rather than continentally integrative, measures. Although their motives differ, both countries recognize that the protections offered by borders (belts) take precedence over those provid...

  • Judicial alteration of the meaning of civil marriage from union of a man and woman to the union of any two persons raises a number of legal issues not raised by legislative redefinition; these are separation-of-powers issues centered in notions of the proper scope and role of judicial review, creation of standards to guide judicial application of broad and open-ended constitutional guarantees like equality, liberty, and dignity, judicial deference to the political branches, and the like. Here, Stewart examines whether the tasks of the judiciary in these areas are done well by citing appellate cases.
