The changes arrived in 1997 by way of a Supreme Court of Canada ruling on a British Columbia murder and the accused man, Michael Feeney. The case changed the legal obligations of police when arresting people in homes by mandating them to obtain a new kind of search authorization -- the so-called Feeney warrant.
Search warrants had always been restricted to non-human entities: stolen property, drugs, guns but never the bad guy. Before Feeney, police relied on their judgment and wits to arrest people who were hiding out in houses. Parliament reasoned that a Feeney warrant, issued only by justice authorities, was a safeguard against state oppression while offering legal backup for the police.
