"Sundance owed the plaintiffs a duty of care and in breach of the duties owed by Sundance to the plaintiffs is wholly negligent by virtue of its duty of care as the owner and operator of the hot air balloon," says a statement of claim filed last Friday on behalf of passengers Robert Palmer and Bruce Kemp. Kemp's claim lists as damages the fact he suffers from "extreme anxiety, binge abuse of alcohol, and marital difficulties and disharmony." Palmer says he has suffered depression and mania, leading to three separate mental breakdowns requiring hospitalization.

All three are also suing the Attorney General of Canada, who is responsible for Transport Canada, for "failing to inspect the balloon" and for "failing to confirm that the balloon met airworthiness standards before issuing a certificate of airworthiness." The balloon's manufacturer, Firefly Balloons, is also named in all five lawsuits.

"It's been brutal," he said. Wet and miserable weather forced Sundance to cancel all its Winnipeg flights in May and June, and [Barry McGonigle] expects flights to drop by at least 40 per cent this season.
