My role as an investigator was to provide a recommendation as to whether there was a reasonable basis for the complaint of discrimination to move forward to the next stage. This recommendation was considered by the Ontario Human Rights Commission whose role is akin to that of a preliminary inquiry judge deciding if there is some evidence which would allow a case to go further. There is a low threshold for referral of a case to the mediation stage, well below that of a "conclusion." A "finding" or "conclusion" of discrimination can only be made by the Manitoba Board of Adjudication after a full hearing in which all of the evidence has been heard. In this case, no decision has yet been made as to whether to send the case to a board of adjudication.
