Description:

Competition law seeks to promote the proper functioning of markets in order to deliver benefits including lower prices, greater choice, and innovative products to consumers. To this end, it employs provisions such as the criminal prohibitions of price fixing and other conspiratorial behaviour, powers to review mergers that may prevent or lessen competition, and remedies for practices by dominant firms that exclude competitors or create barriers to entry. Canadian Competition Law and Policy provides a succinct description of the Competition Act scheme, and of enforcement guidance issued by the Competition Bureau. It employs extensive case examples to illustrate legal tests and other concepts. The book offers a practical guide to Canada’s competition law regime to students, lawyers, and others interested in the subject by providing an overview of the legislative history, along with an approachable outline of key economic concepts and methodologies employed in the analysis of competition law problems. This updated version of the book tracks three rounds of important amendments made to the Competition Act in the period 2022–24. These are the most significant changes to the Act since the major rounds of amendments which occurred in 1986 and 2009. The Competition Bureau has not yet completed its revisions to the various Guidelines which set out guidance on its enforcement approach in light of the amendments. A Second Edition of the book will be published following the completion of those Guidelines
