ABORIGINAL LAW
Aboriginal law is a complex and multi-dimensional area of the law dealing with Canada’s
indigenous peoples. It covers as many civil aspects (e.g., who is aboriginal?) as it does ter-
ritorial ones (land claims, etc.) and at times strays into criminal law (e.g., hunting and f‌ish-
ing offences). Largely a subset of constitutional law, it is a particularly challenging area of
practice given its complexity, originality, and dynamism. It is essentially federal in scope (i.e.,
the Indian Act) but is affected by many matters which are provincial in nature. Related topics:

AUTOCHTONES
Domaine complexe et déroutant, le droit autochtone, en pleine effervescence, couvre autant
les aspects civilistes (personnes : qui est autochtone ?) que les dimensions territoriales (les
réserves, les revendications). Sous-ensemble congru du droit CONSTITUTIONNEL, le droit
AUTOCHTONE, sous le double effet de la Charte canadienne des droits et libertés et de l’actualité,
touche à un très grand nombre d’aspects. La question autochtone pose au droit des déf‌is iné-
dits par sa complexité, son originalité et son dynamisme.
