About the Authors

Matthew Asma studied computer science and philosophy at the Institute for the

History and Philosophy of Science and Technology at the University of Toronto (Hons

BA, 2003), and then law at Dalhousie University (LLB, 2006). He took part in Dal’s

clinical class in criminal law, and received the University Medal in Law. He was called

to the Bar of Ontario in 2007, and since then he has worked within Ontario’s Ministry

of the Attorney General as counsel in the Crown Law Oce—Criminal. His legal

practice consists of advising police on search and privilege issues, prosecuting trials

in complex fraud cases, and conducting criminal appeals in the Ontario Court of Appeal

and the Supreme Court of Canada.

He is also regularly involved in continuing professional education for lawyers and

police, having taught at the Toronto Police College, Ontario Provincial Police annual

conferences, Osgoode Professional Development education programs, and many

Crown education events. He is a course director of the annual Search & Seizure course

in the Ontario Crown Attorneys’ Association summer school program and is a member

of The Advocates’ Society.

Matthew Gourlay is a partner at Henein Hutchison LLP in Toronto. He practises

primarily criminal and regulatory law, with a focus on appellate litigation and profes-

sional discipline. He appears regularly in the Ontario Court of Appeal and serves on

the roster of pro bono duty counsel assisting unrepresented appellants in that court. He

has argued a number of cases in the Supreme Court of Canada. His appellate work

encompasses criminal, regulatory, and civil matters. He is a legal editor of the Canadian

Criminal Cases, a regular columnist on criminal justice issues for the Law Times, and

a frequent speaker at continuing professional education events.

He graduated as gold medallist from the University of Toronto Faculty of Law in

2008. He then served as a law clerk to Chief Justice Beverley McLachlin. He has

practised with Henein Hutchison since 2010.
