About the Authors

Eric V Gottardi, QC,is an experienced trial and appellate counsel who practises

primarily in the areas of criminal defence, constitutional law, and extradition law. He

has worked on special prosecutions in British Columbia and Ontario. He regularly

appears as counsel before the BC Court of Appeal and has argued cases for parties

and interveners at the Supreme Court of Canada. Eric is a former chair of the CBA

National Justice Section and acts as a founding co-chair for the National CBA Annual

Criminal Law conference. He was awarded the CBABC’s President’s Medal in 2013

for his long-standing service to the profession. Eric is a planner and faculty member

of the Federation of Law Societies’ National Criminal Law program. He is a faculty

member with the Supreme Court Advocacy Institute and is currently an editor of the

Charter of Rights Newsletter. He regularly speaks at continuing legal education semi-

nars and often appears as a legal commentator for the CBC and other news outlets.

Jennifer A MacLellan, QC, is a senior Crown counsel with the Appeals and Special

Prosecutions branch of the Nova Scotia Public Prosecution Service. She has argued

appeals at the Supreme Court of Canada and is an advisor with the Supreme Court

Advocacy Institute. Jennifer regularly appears as counsel before the Nova Scotia

Court of Appeal and has conducted conflict prosecutions in Ontario, New Brunswick,

and Manitoba. Before focusing on appellate work, Jennifer prosecuted trials for many

years in both adult and youth court. Jennifer is an International Fellow of the National

Attorneys General Training and Research Institute in Washington, DC. She has pre-

sented on criminal law topics to a wide range of audiences, including lawyers, police

and provincial investigators, students, and the media. She was awarded her Queen’s

Counsel designation in 2016. Jennifer is from Inverness, Nova Scotia.

Michael Lacy, BA, LLB, is an experienced trial and appellate counsel who practises

primarily in the area of criminal defence. He regularly appears as counsel before the

Ontario Court of Appeal and has argued cases for parties and interveners at the Su-

preme Court of Canada. He is a former president of the Criminal Lawyers’ Associa-

tion and continues to serve on their intervention committee. He acts pro bono as duty

counsel for the Ontario Pro Bono Inmate Appeal Program and volunteers as a mock

judge for the Supreme Court Advocacy Institute. He has co-authored other books and

regularly speaks at continuing legal education seminars in the area of criminal law.
