About the Authors
Erin Winocur has been a prosecutor for 29 years. She has represented the Crown in
countless sentencing hearings and plea negotiations on all types of Criminal Code
oences. Ms Winocur was seconded from her work as a trial Crown to the Criminal
Law Policy Branch between 2008 and 2013. There she worked on legislative reform
projects, such as the reforms to self-defence, identify theft, and the provisions that
govern the sentencing of people convicted of multiple murders. She was part of a
specialized team created by the Criminal Law Division of the Ministry of the Attorney
General that worked to address the overrepresentation of Indigenous people in the
justice system. Ms Winocur regularly appears in Toronto’s specialized courts, includ-
ing the Gladue Court for Indigenous Oenders and Mental Health Court. She teaches
trial advocacy at Osgoode Hall Law School and regularly lectures on sentencing and
a wide range of criminal law topics at Queen’s University, the Federation of Law
Societies of Canada National Criminal Law Program, the National Judicial Institute,
and Osgoode Professional Development. She is the parent of twin daughters.
Danielle Robitaille has a bachelor’s degree from the University of Toronto and an
LLB from Dalhousie University, where she won the Muriel Duckworth Award for
raising consciousness of women’s issues and feminism in the legal community.
MsRobitaille is the managing partner at Henein Hutchison Robitaille LLP, where her
practice focuses on criminal, regulatory, and disciplinary litigation at both the trial and
appellate levels. She also acts in select civil matters and leads internal investigations
for businesses and organizations. Ms Robitaille is a fellow of the American College of
Trial Lawyers. In April 2016, Ms Robitaille was appointed senior counsel to the
Honourable Justice Michael Tulloch on the Independent Police Oversight Review,
which delivered its sweeping law-reform report to the Ontario government in March
of 2017. Ms Robitaille’s practice takes her all over the province of Ontario, and she
frequently appears in high-profile litigation and investigations.
Ms Robitaille has lectured extensively on trial advocacy, expert evidence, and ethical
issues at the Law Society of Ontario, the Federation of Law Societies, Osgoode Profes-
sional Development, the Advocates’ Society, the Oce of the Chief Coroner of
Ontario, and the Ontario Court of Justice. She is the parent of thirteen-year-old twins.
