About the Authors
Grace Hession David articled with the law firm Osler, Hoskin & Harcourt LLP and
Imperial Oil Limited in 1991. After articles, she was selected to clerk with the Ontario
Court (General Division), as it was in 1992. She was assigned to the criminal long trials
team and clerked for Justice Moldaver, as he then was. Clerking on the long trials team
resulted in a life-long passion for criminal law. In 1993, Mrs Hession David was hired
as an assistant Crown attorney in Thunder Bay. Mrs Hession David subsequently
served in private practice from 1996 to 2005, worked with the Ontario Teachers’ Pen-
sion Plan, and acted as Adjudicative Counsel with the Ontario Securities Commission.
In 2005, she joined the law firm of Hunt Partners LLP and practised criminal defence
until 2011 when she became one of the initial members of the Toronto Crown’s oce
Specialized Fraud Prosecutions team. She has also worked as an assistant Crown
attorney prosecuting fraud and organized crime with the Guns and Gangs Unit in
Toronto. Recently, she moved to her home province of Saskatchewan where she is
counsel with the Financial and Consumer Aairs Authority of Saskatchewan in the
beautiful city of Regina.
Mrs Hession David has been an active member of the Executive of the Ontario Bar
Association Criminal Justice Section since 2011. She has given presentations on the
detection and prosecution of fraud to the International Financial Crimes Investigators
Conference, the Ontario Provincial Police, the Toronto Police Service, the Law Society
of Ontario, the Criminal Lawyers Association, and the Ontario Crown Attorneys As-
sociation at their annual educational sessions.
Ian Smith was called to the Ontario bar in 1991 and holds degrees from Queen’s
University (BA Hons and LLB) and Oxford University (BCL). He practices at the firm
of Fenton, Smith Barristers in Toronto and handles criminal, regulatory, and profes-
sional discipline matters. Before entering private practice, he was counsel at the Ontario
Securities Commission and at the Crown Law Oce—Criminal at Ontario’s Ministry
of the Attorney General. Mr Smith has appeared at all levels of court in Canada,
including more than a dozen appearances before the Supreme Court of Canada, and
he has taught at the Faculty of Law at Queen’s University, Osgoode Hall Law School,
and the Faculty of Law at the University of Western Ontario. Mr Smith is Chair of the
Pro-Bono Inmate Appeal Program and is a member of the Chair’s Practice Roundtable
