From my perspective, the seed that grew into this book was planted by Justice James

Stribopoulos, who kindly included both Matthew Gourlay and me in a panel presen-

tation about developments in section24(2) of the Charter that was given at the Osgoode

Professional Development symposium on search law in 2015. I thank both of them for

the opportunity. I also thank the general editors of this Emond criminal law series,

Brian Greenspan and Justice Enzo Rondinelli, for guiding this exciting new series and

for involving me in this book. I extend special thanks to Justice Gary Trotter for his

kind foreword.

I gratefully acknowledge the work and skill of the team at Emond Publishing who

helped turn the idea into a manuscript, and the manuscript into a professional published

I want to acknowledge my late colleague Earl Fruchtman, who first got me interested

in criminal law when I was an undergraduate philosophy student and took his intro-

duction to law course just for fun. I would likely not have gone to law school had it not

been for Earl’s manifest excitement about the law and his passion for justice. I was also

fortunate while in law school to have my interest in criminal law nurtured by Professor

Steve Coughlan and judges Frank Hoskins and Barbara Beach, who all influenced the

direction of my education in law and my legal career.

I credit my many inspiring colleagues, past and present, in the Crown Law Oce—

Criminal for providing a collegial and stimulating home in which to practise criminal

law, and for teaching me both by mentorship and by excellent example. Thanks as well

to two colleagues in the Constitutional Law Branch, Hart Schwartz and Zachary Green,

for holding my hand through a couple of section52(1) challenges early in my career.

Finally, great thanks to my very patient and understanding wife, Jia, who gave me

the time and encouragement to see this work through to completion.
