Breach - Remedies of buyer - Rescission - Innocent misrepresentation - The plaintiff farmer purchased a used haystacker from the defendant, who represented that the haystacker would work with the 540 rpm power take-off on the plaintiff's only tractor - The haystacker would operate only on a 1,000 rpm power take-off - The Alberta Court of Queen's Bench allowed the plaintiff's action for rescission of the contract of sale and a return of the purchase price on the ground of the defendant's innocent misrepresentation.
