Summary:

Adil, her husband and five children fled Afghanistan due to repeated threats from a local warlord to kidnap and marry Adil's eldest daughter. In Tajikistan, Adil applied for a Canadian permanent resident visa as a member of the Convention refugee abroad class or as a member of the humanitarian-protected persons abroad class. A visa officer denied the application. Adil applied for judicial review.

The Federal Court allowed the application. The decision was quashed and returned for reconsideration by a different officer.

Admission - Immigrants - Application for admission - Immigrant visa - Duty of officer (incl. duty of fairness) - Adil, her husband and five children fled Afghanistan due to repeated threats from a local warlord to kidnap and marry Adil's eldest daughter - In Tajikistan, Adil applied for a Canadian permanent resident visa as a member of the Convention refugee abroad class or as a member of the humanitarian-protected persons abroad class - A visa officer denied the application - The Federal Court allowed Adil's application for judicial review - The basis of the officer's decision was a general negative credibility finding based on supposedly fake diplomas and Adil's vagueness in response to the officer's questions - While a claim could be rejected on general negative credibility findings, these had to be made in clear and unmistakable terms - Discrepancies had to be placed before the applicant with an opportunity to explain - This did not occur - The officer's refusal to take into account highly material evidence regarding the basis of the negative credibility finding was a breach of procedural fairness that, in itself, required a reconsideration of the decision - Even more problematic was the officer's attempt through a subsequent affidavit to bolster and expand on the decision - The affidavit was an obvious attempt to shore up a defective decision and was not admissible for that purpose - Finally, the affidavit revealed that the decision was made on extrinsic evidence and discrepancies that were never put before Adil - This contradicted the officer's statement in the computer assisted immigration processing system notes that he would place his concerns before Adil - This was a further breach of procedural fairness - The decision was quashed and returned for reconsideration by a different officer - See paragraphs 48 to 70.
