Alberta Mortgage and Housing Corporation

(formerly Alberta Home Mortgage Corporation) v. Ciereszko, Craik and Craik

No. 8401 - 32207

Indexed As: Alberta Mortgage and Housing Corporation v. Ciereszko et al.

Alberta Court of Queen's Bench

Judicial District of Calgary

MacDonald, J.

November 7, 1985.

Summary:

The Alberta Mortgage and Housing Corporation (AMHC) applied for an order to foreclose on a mortgaged property and for a deficiency judgment. A master of the Alberta Court of Queen's Bench, in a decision not reported in this series of reports, granted the foreclosure order but refused to grant the deficiency judgment. The AMHC appealed.

The Alberta Court of Queen's Bench dismissed to appeal. The court held that AMHC had no authority under its empowering legislation to seek a deficiency judgment.

Mortgages - Topic 5555

Mortgage actions - Foreclosure and sale - Deficiency judgment - Bars - Crown agents - Where agent lacked statutory power to claim deficiency - Alberta Mortgage and Housing Corporation - The Alberta Mortgage and Housing Corporation Act and regulations thereunder provided that where the corporation proceeded against property under a mortgage, it had to apply for foreclosure and possession and if a deficiency existed it had to reimburse itself from the mortgage insurance fund - The Alberta Court of Queen's Bench held that since there was no indication that the legislature intended the corporation to pursue a deficiency judgment other than from the insurance fund, the corporation had no power to pursue a deficiency judgment - See paragraphs 1 to 36.

Statutes - Topic 5030

Operation and effect - Statutory corporations - Powers - Limitations imposed by governing statute and regulations - The Alberta Court of Queen's Bench distinguished between the powers of a corporation established by a royal charter and a corporation established by a special act of parliament (statutory corporations) - The court referred to the rule that a statutory corporation is limited in what it can do by the powers given to the corporation by its empowering statute - See paragraphs 11 to 26.
