Thinking About Legal Research
Sometimes, legal research merely means finding a particular statute, regulation, or
case. Analysis of facts and issues may not be necessary. At other times, however, legal
research means finding what the law says about a particular fact situation. When this
happens, going to the library or turning on the computer to look for cases and stat-
utes is not the first thing to do. The first thing to do is think: to analyze the given facts
in order to identify the relevant issues; to get your bearings in the applicable law; and
to determine the tools you’ll need to do the research.
