Summary:
The plaintiff was seriously injured in a motor vehicle accident. He commenced an action against the defendants for damages for personal injuries.
The British Columbia Supreme Court allowed the action and assessed damages accordingly, finding the plaintiff 25% at fault. The plaintiff appealed the damages assessment and the finding of contributory negligence.
The British Columbia Court of Appeal allowed the appeal, but did not disturb the finding of contributory negligence.

General damages - Personal injuries - Prospective loss of wages or earnings - A male in his twenties was disabled because of a motor vehicle accident - Prior to the accident he never had steady employment - Rather, he was categorized as a "wheeler-dealer" or an "entrepreneur" - Through his business dealings he had acquired a number of assets - The British Columbia Court of Appeal discussed the difficulties of calculating a damage award for loss of future earning capacity in such a case - The court stated that "there cannot be a conventional award for this loss, but there can be an arbitrary one which falls within the area of rationality" - The court fixed the award for loss of "unconventional earnings" at $150,000 - See paragraphs 1 to 21.
