CONVENTION SUPPLEMENTARY TO THE WARSAW CONVENTION FOR
THE UNIFICATION OF CERTAIN RULES RELATING TO INTERNATIONAL
CARRIAGE BY AIR PERFORMED BY A PERSON OTHER THAN THE
CONTRACTING CARRIER, SIGNED IN GUADALAJARA, ON 18 SEPTEMBER
1961 (GUADALAJARA CONVENTION 1961)
THE STATES SIGNATORY TO THE PRESENT CONVENTION
NOTING that the Warsaw Convention does not contain par ticular rules
relating to internat ional carr iage by air performed by a pe rson who is not a
party to the ag reement for carriage
CONSIDERING that it is therefore desirable to formulate rules to apply
in such circumst ances
HAVE AGREED AS FOLLOWS:
Article I
In this Convention:
(a) “Warsaw Convention” means the Convention for the Unif‌ication of
Certain Rules Relat ing to International Car riage by Air signed at
Warsaw on 12 October 1929, or the Warsaw Convention as amended
at The Hague, 1955, according to whether the carriage under the
agreement referred to in pa ragraph (b) is governed by the one or by
the other;
(b) “contracting carrier” means a person who as a principal makes an
agreement for car riage governed by the Warsaw Convention with a
