Appendix G: Carriage by Air Act 1961
CARRIAGE BY AIR ACT 1961

An Act to give effect to the Convention concerning international carriage by
air known as “the Warsaw Convention as amended at The Hague, 1955”, to
enable the rules contained in that Convention to be applied, with or without
modif‌ication, in other cases and, in particu lar, to non-international carriage
by air; and for connected purposes.

Convention to have the fo rce of law
1. — (1) The applicable provisions of the Carriage by Air Conventions have
the force of law in the United Kingdom in relation to any carriage by a ir to
which t hey apply, irresp ective of the nationality of t he airc raft performing
that carria ge.
(2) Subsection (1) does not apply in relation to Community air carriers to
the extent that the provisions of the Council Regulation have the force of law
in the United Kingdom.
(3) Subsection (1) is subject to the other provisions of this Act.
(4) If more than one of the Carriage by A ir Conventions applies to a car-
riage by air, the applicable provisions that have the force of law in the United
Kingdom a re those of whichever is the most recent applicable Convention
in force.
