NOTICE OF APPLICATION FOR INTERVENER STATUS

(Pursuant to Rule 23(1) of the Criminal Appeal Rules)

TAKE NOTICE that an application will be made on behalf of the Applicant / Proposed

Intervener, before the Honourable Chief Justice, the Honourable Associate Chief Justice,

or a Justice that they designate, on Thursday, August 11, 2016, for an Order pursuant to

the Rule 23 of the Criminal Appeal Rules granting the Criminal Lawyers’ Association

(Ontario) (“CLA”) the status of intervener in the above appeal.

The Grounds for this Applicant are as follows:

1. The CLA has a direct interest in the issues raised in this appeal;

2. The CLA’s submissions will be useful to the Court and different from those of the

other parties; and,

3. The CLA’s submissions will not cause any injustice to the immediate parties’

positions on the appeal.
