Indians, Inuit and Métis - Topic 6266
Government of Indians - What laws govern - Provincial laws of general application - The Alberta Director of Maintenance and Recovery brought an application against an Indian man respecting his failure to make maintenance payments on behalf of an Indian mother and her children under the Maintenance and Recovery Act, R.S.A. 1970, c. 223 - The man opposed the application on the ground that the Act was inapplicable to Indians - The Alberta Court of Queen's Bench allowed the application and held that the Maintenance and Recovery Act was applicable to Indians in Alberta, because it was a law of general application in the province and was not inconsistent with the provisions of the Indian Act, R.S.C. 1970, c. I-6.
