BIOETHICS

Considered to be at the crossroads of ethical questions related to life and death, bioethics

raises two diff‌iculties for lawyers as a f‌ield of study. On the one hand, ethics are distributed in

a variety of f‌ields (e.g., medicine, pharmacy, and other professions); on the other hand, other

disciplines intervene (e.g., theology, philosophy, sociology, biology, etc.) so that the lawyer is

not the sole decision-maker and is not guided exclusively by matters of law.

BIOÉTHIQUE

Carrefour des questions éthiques liées à la vie et à la mort, la bioéthique, comme champ d’étu-

de, pose deux diff‌icultés aux juristes. D’une part, l’éthique se trouve répartie dans une foule

d’aspects ou de domaines éclatés (médecine, pharmacie, déontologie professionnelle) ; d’autre

part, d’autres disciplines interviennent sur les problèmes (théologie, philosophie, sociologie,

biologie, etc.), ne laissant plus le juriste seul à décider. Les problèmes particuliers du consen-

tement aux soins sont réglés au Code civil et souvent abordés dans les ouvrages traitant de la

PERSONNE ou de la SANTÉ – MÉDECINE.
