Summary:

The defendants' appeal was placed on the inactive list. A Chambers judge dismissed the appeal as abandoned and dismissed the defendants' application for leave to proceed with the appeal. The defendants appealed, which was analogous to an application to extend the time to file their factum.

The British Columbia Court of Appeal allowed the appeal and ordered that both the appeal and cross-appeal proceed.

Appeals - Bar or loss of right of appeal - Relief from - The defendants' appeal was filed in time but the appeal books were filed late by consent - The delay in filing the factum was explained and it was now ready to be filed - The judgment was paid in full and the parties were ready to pro­ceed with the appeal - Although the appeal was of "dubious merit", that did not mean it was bound to fail - The British Columbia Court of Appeal held that the interests of justice would best be served by allowing the appeal (and cross-appeal) to proceed.
