Scope Alternative dispute resolution - or ADR - has developed into its own discipline and practice area, in part because of the delays inherent in the traditional litigation system: individuals and companies need a fast, effective method to resolve disputes. ADR includes arbitration (where parties submit their dispute to one or more impartial persons for a final and binding ruling) and mediation (where a neutral person tries to mediate a settlement between the parties but does not have the power to make a binding ruling on the parties). ADR involves a combination of legislation (i.e., Ontario’s Arbitration Act, 1991, S.O. 1991, c. 17), the possible adoption of arbitration rules or procedures from various organizations (such as the American Arbitration Association), contract law, and advocacy skills.
