Summary:

The plaintiffs applied under Rule 307 of the Federal Court Rules for an order that a Notice of the Statement of Claim be served on the defendant Specialty Composites at its offices in Delaware (U.S.A.). The Associate Senior Prothonotary, in a decision reported at paragraphs 14 to 26 below, dismissed the application without prejudice to the right of the plaintiffs to launch another application based on additional or better material. The plaintiffs appealed and alternatively moved for an order under Rule 307 allowing the service ex juris.

The Federal Court of Canada, Trial Division, rather than dealing with the appeal from the order of the Prothonotary, considered the application on the merits and allowed the application for service ex juris.

Rules of court - Procedures not provided for in rules - Gap rule - A witness would not provide an affidavit supporting the plaintiffs' application for service ex juris - The plaintiffs attempted to get the evidence of the witness before the court through use of the "Gap rule" by using an Ontario Civil Procedure Rule which allowed examination of witnesses before the hearing of an application - Specifically the plaintiffs had the court subpeona the witness to an examination at his office before counsel for all parties and a court reporter - A certified copy of the evidence was then provided to the court - The Federal Court of Canada, Trial Division, held that this was an appropriate use of the "Gap rule", considered the examination of the witness and granted the order for service ex juris.
