Summary:

Scott & Aylen represented both the creditor Caisse populaire Ste-Anne-Laurier d'Ottawa Inc. and the debtors Staltari with respect to the settlement of a claim connected with a residential development project known as "Water Park Place". The Caisse subsequently brought another action in connection with Water Park Place. It applied for a new affidavit of documents from the respondents, which included Scott & Aylen, and sought production of all allegedly relevant documents, including the Staltari documents. The respondents Scott & Aylen invoked privilege and argued against production of the Staltari documents.

A Master of the Ontario Court (General Division) allowed the application.
