Summary:

The Crown applied for an order under s. 16(1) of the Controlled Drugs and Substances Act (CDSA), for forfeiture of the net mortgage sale proceeds from Dew's home. The home was offence-related property within the meaning of the CDSA, Dew's wife having been convicted of a designated substance offence. Dew applied for relief from forfeiture under ss. 19(3) and 19.1(3) of the CDSA.

The Manitoba Court of Queen's Bench held that the net mortgage sale proceeds were forfeited under s. 16(1). Relief from forfeiture was denied.

Penalties - Forfeiture of seized goods - When available (incl. offence-related property) - The Crown applied for an order for forfeiture of the net mortgage sale proceeds from a home registered solely in Dew's name (Controlled Drugs and Substances Act (CDSA), s. 16(1)) - Counsel agreed that the home was offence-related property within the meaning of the CDSA, Dew's wife having been convicted of a designated substance offence - Dew applied for relief from forfeiture under ss. 19(3) and 19.1(3) of the CDSA - The Manitoba Court of Queen's Bench held that in light of counsel's agreement that the property was offence-related and that a designated substance offence was committed a forfeiture order was mandatory - Relief from forfeiture was denied - Dew failed to satisfy the court, on a balance of probabilities, that relief should be granted to him (i.e., that he was innocent of complicity and collusion) - Further, the exercise of a residual discretion was denied - The court found, as well, that the impact of an order of forfeiture was not disproportionate in the circumstances - See paragraphs 42 to 77.
