Summary:
A worker applied for unemployment insurance benefits. The Unemployment Insurance Commission ruled that her benefit rate was nil because her earnings from her last 20 weeks of insurable employment were also nil. The worker appealed.
A Board of Referees dismissed the appeal. The worker appealed.
An Umpire allowed the appeal. The Commission applied for judicial review.
The Federal Court of Appeal, Robertson, J.A., dissenting, quashed the Umpire's decision and remitted the matter to an Umpire to be designated by the Chief Umpire for a new disposition on the basis that the worker's appeal from the Board of Referees should be dismissed.

Claims - Application for benefits - Benefit rate - A university terminated Cymer-man's employment in June 1991 with $49,000 severance pay - The allocation postponed any possible unemployment insurance claim by 15 months to September 1992 - However, Cymerman obtained insurable employment from Royal Lepage from November 1991 to June 1992 (32 weeks) - Cymerman received no commissions during that period and hence had no insurable earnings - Cymerman claimed unemployment insurance benefits - The Commission submitted that Cymerman's benefit rate was nil because her earnings from her last 20 weeks of insurable employment, i.e., with Royal Lepage, were also nil - Cymerman claimed that her benefits should be calculated on her employment with the university - The Federal Court of Appeal held that Cymerman's benefit rate was nil because she had no earnings during her last 20 weeks of insurable employment - See paragraphs 1 to 19.
