(Suit No. 10/89)

Indexed As: Carignan v. Carignan

Manitoba Court of Appeal

O'Sullivan, Huband and Lyon, JJ.A.

November 6, 1989.

Summary:

A divorced wife appealed the dismissal of her claim for child support from his stepfather, reported 55 Man.R.(2d) 118.

The Manitoba Court of Appeal dismissed the appeal.

Family Law - Topic 2203

Maintenance of wives and children - General principles - Persons obligated to support children - In loco parentis - The Manitoba Court of Appeal affirm ed the refusal to order child support from a stepfather who had terminated the relationship of "in loco parentis" - The court, however, did not approve the restriction that there must be acquiescence by the wife and/or the child in the termination - The court comprehensively reviewed conflicting case law considering the relationship of "in loco parentis" and held that the relationship applied when the burden of providing for a child had been voluntarily assumed and could be terminated unilaterally.

Family Law - Topic 4024

Divorce - Corollary relief - Maintenance awards - To stepchildren - [See Family Law - Topic 2203 above].
