Summary:
A couple with no children separated after a long term marriage. The wife sought monthly spousal support of $1000 payable indefinitely. She claimed that she suffered from obsessive compulsive disorder which affected her capacity to obtain employment.
The Alberta Court of Queen's Bench allowed the spousal support claim in part, ordering the husband to pay monthly support of $500, reviewable in a year.

Divorce - Corollary relief - Maintenance and awards - Awards - Periodic payments -A couple with no children separated after a long-term marriage - The wife sought support - She claimed that she suffered from obsessive compulsive disorder which affected her capacity to obtain employment - The Alberta Court of Queen's Bench ordered the husband to pay monthly support of $500, reviewable in a year - In arriving at this sum, the court used the Federal Child Support Guidelines by analogy (i.e., the guideline amount for a child of the husband's level of income was $256 per month, which the court essentially doubled to reflect the fact that spousal support was tax deductible whereas child support was not) - The court noted also that the wife had an obligation to access community resources; however, her ability to obtain funding would not, in the circumstances, reduce the husband's obligation to pay support - See paragraphs 1 to 66.
