Summary:

The plaintiffs' home and contents was insured with the defendant under a "home­owner's plus" policy. The policy insured against loss or damage to property caused by 14 specified perils, including fire or light­ning, and theft. On December 16, 1991, property was stolen from the residence. The plaintiffs filed a proof of loss on January 28, 1992, which was rejected by the defendant insurer on February 23, 1992. The plaintiffs filed a second proof of loss on November 4, 1992. The plaintiffs sued the defendant insurer on March 26, 1993. The defendant insurer applied on summary trial under rule 18A for dismissal of the plaintiffs' action on the ground it was brought beyond the time limited by contract.

The British Columbia Supreme Court allowed the application and dismissed the plaintiffs' action. See 23 B.C.T.C. 67, for a decision on costs. The plaintiffs appealed.

The British Columbia Court of Appeal allowed the appeal, set aside the judgment below and held that the plaintiffs' action was commenced within the applicable statutory time limit prescribed by s. 22(1) of the Insurance Act.
