Summary:

A client applied for the taxation of her lawyer's account. The taxing officer taxed the account at $40,000.00 (a reduction of $20,000.00) and $5,777.00 for disbursements. The client appealed.

A Motions Court judge dismissed the appeal. The client appealed.

The Ontario Court of Appeal allowed the appeal and taxed the account at $25,000.00 plus disbursements.

Compensation - Measure of compensation - Effect of "understanding" respecting maximum fee - Upon being retained a lawyer wrote the client and stated the total fees and disbursements "will certainly exceed $10,000.00 and may be as high as $50,000.00" - The lawyer was dismissed prior to completion of the matter and submitted an account in excess of $60,000.00 - The Ontario Court of Appeal held that $50,000.00 was the maximum fee agreed upon - The Court of Appeal taxed the lawyer's account at $25,000.00 plus disbursements (which took into consideration the work done and the fee to which the lawyer would have been entitled if he had successfully completed the matter).
