Summary:

The Yukon Supreme Court issued several orders requiring the Commission Scolaire Francophone du Yukon No. 23 to put in place numerous measures of compliance in respect of its French language minority schooling obligations under s. 23 of the Canadian Charter of Rights and Freedoms. The Commission Scolaire appealed. It also applied for a stay of execution pending appeal.

The Yukon Court of Appeal, per Groberman, J.A., allowed the application in part.

Appeals - Stay of proceedings pending appeal - What constitutes "irreparable harm" - The trial judge issued several orders requiring the Commission Scolaire Francophone du Yukon No. 23 to put in place numerous measures of compliance in respect of its French language minority schooling obligations under s. 23 of the Canadian Charter of Rights and Freedoms - Those measures included the expansion of a school, construction of temporary classrooms and holding a trust fund - The Commission Scolaire appealed and sought a stay of execution pending appeal - The Yukon Court of Appeal, per Groberman, J.A., allowed the application in part - The court ordered a stay in respect of the above described measures - The Yukon Government would suffer irreparable harm if it had to finance the Commission Scolaire's monetary obligations in that it would be unable to recover the expenditures - In addition, the balance of convenience favoured granting the stay - See paragraphs 12 to 34.
