Conclusion
THIS HaNdBOOk SET out to introduce junior lawyers to
several of the concepts, situations, and practices that re-
late to mediation. ere is little that can replace experi-
ence. e more experience that litigators receive, the
better armed they are for the next case.
Hopefully, this handbook has contributed to the ex-
perience of that litigator. As Oscar Wilde stated, “Experi-
ence is the name everyone gives to their mistakes.” If this
handbook allows the junior litigator to avoid one serious
mistake, it will have been a success. If this handbook al-
lows the junior litigator to assess what went wrong, it
should allow that litigator to avoid the mistake in the fu-
ture. How foolish do professionals feel when they repeat
their mistakes? It is problematic to chalk up a repeated
mistake to experience.
e thoughtful reader will not agree with everything
written, either by the author or by the contributing medi-
ators. In some cases, what is written will conict with
what the reader has experienced. In many cases, what is
written will simply add to the comprehension that the
litigator accumulates in daily practice.
