CONSTITUTIONAL LAW
These titles deal with the constitutional foundations of Canada as enacted by the Constitu-
tion Act, 1867 (formerly the British North America Act). They principally deal with the division
of federal and provincial powers and the various criteria for determining jurisdiction in the
absence of clear articulation thereon by the Act. These titles do not deal with constitutional
civil rights per se (for those see HUMAN RIGHTS AND THE CHARTER OF RIGHTS AND

La présence des chartes des droits ne doit pas faire oublier les autres questions de droit public
fondamental, la structure et le fonctionnement des organes de l’État et le partage des compé-
tences législatives entre les parlements du pays. Tous les problèmes remontent d’une manière
ou d’une autre au droit constitutionnel (par ex. la question du territoire canadien, le statut
juridique du MILITAIRE, etc.).
