Judgments and orders - Setting aside judgments - Default judgments - General - The defendant applied to set aside a judgment and a noting in default to allow a statement of defence to be filed in the action - At the hearing of the application counsel for the plaintiff submitted that the court was without jurisdiction - The plaintiff had filed a notice of motion to enter default judgment, but the notice was not served on the defendant - The Northwest Territories Supreme Court stated that under Rule 152 judgment may be entered following a noting in default without notice to a defendant, but where that procedure is adopted, the judgment so obtained is ex parte - The court therefore had jurisdiction to entertain the application brought under Rule 158 - See paragraphs 5 to 11.
