Summary:
Two doctors with anaesthetic privileges at two hospitals had their privileges restricted by resolutions by the respective boards of trustees. The doctors appealed to the Hospital Appeal Board, seeking to quash the resolutions and for return of their full privileges. The doctors alleged they were not given sufficient written reasons as required by s. 38 of the Public Hospitals Act. The Board dismissed their appeals. The doctors appealed.
The Ontario Divisional Court allowed the appeals and remitted the matters to the Board to provide written reasons sufficient to comply with s. 38.

Operation - Doctors - Restriction or revocation of hospital privileges - Reasons for decision - Two doctors had hospital privileges restricted by the boards of trustees of two hospitals - Section 38 of the Public Hospitals Act required written reasons for the decisions - The Ontario Divisional Court held that the reasons given did not comply with s. 38 - The doctors were entitled to know the facts relied on by the boards, their reasoning in concluding what they did, precisely what those conclusions were and preferably the importance attached to each of the facts as they found them to be - The court stated that s. 38 required more than advising the doctors of the case they had to meet.
