The plaintiff fell and was injured in the defendant's store. She alleged negligence in that she was struck from behind by a cart which was being pushed by an employee of the store.

The New Brunswick Court of Queen's Bench, Trial Division, held the defendants vicariously liable for their employee's negli­gence.
