EVIDENCE (CRIMINAL)
Evidence is the means by which an allegation of fact is substantiated at a judicial proceed-
ing. It can be documentary, exhibitory, or oral. There are numerous rules surrounding the
submission of evidence, making it a particularly complicated and actively researched area
of the law. It is both federal and provincial in jurisdiction by way of the Canada Evidence Act,
numerous provincial evidence acts, the rules of court for the various courts of the country, and
evidentiary rules articulated in a variety of individual statutes. This section lists titles that deal
exclusively or primarily with the law of evidence as it relates to criminal cases. Related topics:

PREUVE PÉNALE
Branche importante du droit CRIMINEL et du droit pénal. On applique essentiellement les
mêmes règles dans les deux cas, sauf quant au degré de preuve requise. Le domaine statutaire
provincial ne dispose pas de législation particulière à cet effet, il faut s’en remettre au droit
statutaire fédéral.
