Summary:
The plaintiffs applied under rule 31.10 to discover a nonparty and former employee of the defendants. A Master allowed the application. The defendants appealed, with leave.
The Ontario Court of Justice, General Division, per Sutherland, J., in a decision reported in 1 O.R.(3d) 672, allowed the appeal. The plaintiffs appealed.
The Ontario Divisional Court dismissed the appeal but for different reasons than the trial judge, agreeing in the result. The court varied the costs portion of the judgment.

Discovery - Examination - Persons who may be examined - Nonparties - Civil Procedure Rule 31.10(2) prescribed the conditions precedent to the granting of the discovery of a nonparty - A Master allowed such an application for reasons of costs, delay and convenience - The Ontario Divisional Court held that the Master applied the wrong test - The court held that there must be a refusal, active or constructive, to obtain the information before the applicant will meet the onus under rule 31.10(2)(a) - After the onus has been satisfied, the court may then look to rule 1.04 to decide whether the court's discretion, as set out in rule 31.10(1), should be exercised on the facts of a particular case - See paragraphs 23 to 34.
