Practice - Appeals - Time for - On February 21, 1995, a bankruptcy trustee disallowed a claim filed by Revenue Canada - The Attorney General filed a notice of motion on March 21, 1995, under s. 135(4) of the Bankruptcy and Insolvency Act, appealing the disallowance - The Attorney General mailed the notice of motion on April 6, 1995 and the trustee received it on April 10, 1995 - The trustee argued that the 30 day period for appealing a disallowance as set out in s. 135(4) included both filing and serving of the notice of motion and since the notice was not received until April 10, 1995, the appeal was not perfected in time - A Registrar of the Alberta Court of Queen's Bench, in Bankruptcy, held that although the notice was filed in time it was not served within the 30 day period and therefore not perfected.
