It has been over a decade since Parliament addressed the issue of com-
mercial surrogacy in the Assisted Human Reproduction Act (AHRA)1 and
some provinces and territories brought into eect family law measures to
address parental status issues arising from surrogacy arrangements.
I was the Department of Justice senior legal adviser to Health Canada
during the development and adoption of the AHRA. I continued in that role
as Health Canada developed the extensive regulations required by the legis-
lation, and was co-counsel for the Government of Canada in its defence
of the constitutionality of the Act (the Reference re Assisted Human Repro-
duction Act)2. In response to the  Supreme Court of Canada decision,
extensive amendments were adopted to the statute prior to my retirement
from the Department of Justice. My experience has given me a window on
the evolution of reproductive technologies and the law that governs them.
As the chapters in the present book indicate, key issues pertaining to
surrogacy remain the subject of debate, including commercial surrogacy,
parental status, and globalization and cross-border surrogacy arrange-
ments, which is as it should be.
