FRANCHISING LAW
A franchise is essentially a privilege that is sold, licensed, or granted from one party to an-
other. In commerce, this normally means the right granted from the holder of a trade-mark
to another to trade under that name or to sell its products. In the normal course of events, the
franchisee pays the franchisor money in order to sell the franchisor’s products and in return
the franchisor undertakes to promote the product. A large proportion of the Canadian retail

Le CONTRAT de franchise est un moyen de f‌inancement et de développement d’une entre-
prise ; il constitue un élément important du droit des AFFAIRES. En raison de l’implication des
multinationales, le contrat de franchise recèle souvent une dimension de droit INTERNATIO-
NAL PRIVÉ et s’insère, à l’occasion, dans une dynamique de contrats internationaux.
