Summary:

Gilbert was convicted of breach of bail conditions and domestic assault. He sued, inter alia, three Crown attorneys and a probation officer for various intentional torts arising out of the proceedings. A motion judge dismissed the action. Gilbert appealed.

The Ontario Court of Appeal dismissed the appeal.

Pleadings - Striking out pleadings - Grounds - Abuse of process or delay - Gilbert was convicted of breach of bail conditions and domestic assault - He sued, inter alia, three Crown attorneys and a probation officer for various intentional torts arising out of the proceedings broadly described as abuse of public office - The claim was not framed in malicious prosecution - A motions judge found that the torts claimed all involved conduct that was intentional and not proper in the exercise of the responsibilities of public office - He concluded that to succeed in establishing the claims, Gilbert had to establish "malice" in the sense required for a malicious prosecution action and that he failed to do so - The Ontario Court of Appeal dismissed Gilbert's appeal - The allegations in the statement of claim did not support the allegation of maliciously improper conduct on the part of the defendants, except Gilkinson, against whom there was an allegation that he lied during a bail hearing - The action was properly dismissed as against Gilkinson as an abuse of process because the lying allegation constituted a collateral attack on the bail order that was not contested by Gilbert.
