A
abstract book a book in which the land registry oce keeps
land ownership records, under the registry system.
abode place of residence.
abutting touching along a boundar y of land.
acceptance of service a lawyer’s personal acknowledgment of
receipt of a document on behalf of a client, as well as conrma-
tion that the lawyer represents that client in the action.
access formerly, a parent’s right to visit the child.
account a lawyer’s bill to a client.
act a written law; a statute; legislation.
action a civil lawsuit.
ad hoc for this purpose.
ADR alternative dispute resolution; a mediation process for
settling issues out of court.
administration de bonis non administratis see succeeding
estate trustee without a will.
admission of service a lawyer’s acknowledgment of receipt of a
document on behalf of a client.
adverse party an opposite party to an action.
adverse possession see possessor y title.
adverse witness a witness giving testimony in favour of an
opposite party.
afdavit a document stating facts which a person swears to be true.
age of majority legal age or the age at which a person is deemed
to be an adult under the law. In Ontario it is 18 years.
agenda a list of issues to be discussed at a meeting.
a.m. before noon; Latin: ante meridiem.
amalgamation the merging or joining together of two or more
companies to form one company.
amortize provisions for payment of a debt by xed periodic
payments, calculated to repay the debt, plus interest, over a stated
period of time.
annex to attach.
application a civil lawsuit commenced by a notice of applica-
tion or a court document which begins a family law case.
appurtenant inseparably connected, e.g. an easement or a
covenant attached to a piece of land.
articles of amalgamation a document which joins together two
or more companies.
articles of amendment a document which revises the articles
of incorporation.
articles of incorporation a document which creates a business
corporation.
assessment of costs a court ocer’s examining of a lawyer’s
fees and disbursements in a bill of costs to ensure the amounts
comply with the tari.
assessment ofcer a court ocer who determines that the fees
and disbursements in a bill of costs or in a lawyer’s account to the
client are correct.
assignee a person who receives rights from an assignor and
who can enforce those rights against another.
assignment of mortgage see transfer of charge.
assignor a person who gives rights to an assignee and who can
no longer enforce those rights against another.
associate judge a judicial ocer with less jurisdiction than
that of a judge (formerly, case management master).
assumption statement a statement indicating how much prin-
cipal and interest is outstanding on a charge or mortgage to be
assumed.
at arm’s length a transaction between two unrelated people or
strangers.
ats. at the suit of.
attendance money money paid to a witness for attending to
testify.
attestation clause a clause at the end of a document, such as a
will, where a witness signs, certifying that the document has been
signed in the presence of that witness.
auditor a public accountant authorized by law to examine the
accounts of a corporation on behalf of the shareholders.

bail money or other security given as guarantee that an accused
will appear in court at all stages of a proceeding.
balance of probabilities a standard of proof in civil litigation
where a judge has to believe that one person's story is more likely
than not to be true as compared to the other person's story.
bar of dower formerly, the relinquishing of a widow’s right to a
one-third life interest in her husband’s real property.
barrister and solicitor a Canadian lawyer; as a barrister, the
lawyer argues cases in court; as a solicitor, the lawyer practises in
all other areas of law.
beneciary a person to whom something is given in a will.
bequeath to give personal property by will (archaic).
bequest a gift of property by will.
beyond a reasonable doubt a standard of proof required in
criminal cases.
bigamy marr ying while being already married.
bill of costs a court document itemizing a lawyer’s fees and
disbursements for a party who won judgment and costs.
BIN business identication number; a provincial business name
registration number which the government issues on a certicate
of registration after a person registers a business name.
board of directors persons that a corporation’s shareholders
elect to manage the aairs of the corporation.
